1. Acceptance of Terms
By accessing or using the services, applications, and APIs provided by Flux Drop ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these terms, you may not access or use the Service.
2. Account Registration & Security
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and keep your account details updated. You are solely responsible for maintaining the confidentiality of your account credentials, including API keys and passwords. You must immediately notify us of any unauthorized use of your account or security breaches.
3. Subscriptions, Fees & Payments
We offer both Free and paid Subscription Plans (e.g., Pro Lite, Pro). Subscription fees are billed in advance on a recurring monthly or yearly basis and are non-refundable. Your subscription will automatically renew under the same conditions unless cancelled. We reserve the right to modify subscription fees or plan limits upon 30 days notice. If payment fails, we may suspend access to premium capabilities.
4. Acceptable Use Policy
You agree not to upload, store, host, or transmit files, documents, or content that: (a) is illegal, threatening, harmful, or promotes violence; (b) infringes any intellectual property, privacy, or proprietary rights; (c) contains malware, viruses, trojans, or malicious software; (d) disrupts the operation of the Service, our servers, or networking systems; or (e) is intended to bypass API rate limits or resource quotas. We reserve the right to remove any content or suspend accounts that violate these rules.
5. Storage and Bandwidth Quotas
Each subscription tier enforces specific storage capacity limits and monthly bandwidth limits. If your storage usage exceeds your plan's quota, upload capabilities will be paused until you either delete files to free up space or upgrade to a higher tier. If your monthly bandwidth is exceeded, we reserve the right to throttle delivery speeds or request an upgrade. Files are delivered globally via our CDN edge networks.
6. Intellectual Property & File Rights
You retain full ownership and intellectual property rights over the files, data, and content you upload to the Service. Flux Drop does not claim any ownership rights over your files. By uploading content, you grant us a limited, worldwide license to host, process, and transmit the files solely as required to provide and maintain the Service on your behalf. Flux Drop owns all rights, title, and interest in and to the platform and its source code.
7. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUX DROP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
8. Termination
You may terminate your account and cancel your subscription at any time through the dashboard settings. Upon termination, we will delete your stored files and associated metadata in accordance with our data retention policies. We also reserve the right to suspend or terminate your account at our discretion, without prior notice, if you violate these Terms of Service or engage in activities that threaten the stability of the platform.
